Husband abandoned child: “single mother” is not a sentence

Demographers sound the alarm: in Russia there are more than 10 million single mothers who raise children without the support of her husband. What should women do who find themselves in a difficult life situation and must independently take care of the material well-being of the child?

If the husband refuses to raise children and help them financially, this does not mean that you alone cannot cope. It is difficult to survive the loss of support, but you need to gather strength. From now on, you will have to take care of your children twice as much - for yourself and for the father of the child in order to give them all the best.

The first thing you need to do is register a new social status - a single mother. This will give you the right to receive certain benefits, as well as alimony. If the father does not agree to voluntarily give money to support the child, then they can be recovered through the court - this is prescribed by law.

Do not be proud and do not think that you need anything else from this person: take care first of all of the child - he needs this money. Check your child support law or consult with a lawyer.

Duties of a father to a child under the law

If the husband has stopped communicating with the child and does not participate in the costs of its maintenance, this does not mean a denial of parental rights. Your task is to gather evidence that in reality children are raised without the participation of a father. If there is evidence, then you can easily get child support payments through the courts. Your main tool is Article 71 of the Family Code (denial of parental rights).

Section 71. Consequences of Deprivation of Parental Rights

  1. Parents deprived of parental rights lose all rights based on the fact of kinship with the child in respect of which they were deprived of parental rights, including the right to receive content from him (Article 87 of this Code), as well as the right to benefits and state benefits established for citizens with children.
  2. Deprivation of parental rights does not exempt parents from the obligation to support their child.
  3. The question of further cohabitation of a child and parents (one of them) deprived of parental rights is decided by the court in the manner established by housing legislation.
  4. A child in respect of whom the parents (one of them) are deprived of their parental rights, retains the right of ownership of the dwelling or the right to use the dwelling, and also preserves property rights based on the fact of kinship with parents and other relatives, including the right to inherit .
  5. If it is not possible to transfer the child to another parent or in case of deprivation of the parental rights of both parents, the child shall be transferred to the care of the guardianship authority.
  6. Adoption of a child in case of deprivation of the parents (one of them) of parental rights is allowed no earlier than six months from the date of the court decision on the deprivation of parents (one of them) of parental rights.

The husband wants to abandon the child: what the law says

Alimony is calculated depending on the income of the father of the child. The more he earns, the more money the child will rely on. To learn more about the rules for calculating child support, see article 81 of the Family Code. It states that:

  • with an only child, a father is charged 25% of his income;
  • for two children charge a third of the income;
  • for three or more - 50%.

The size of these shares may be reduced or increased by the court, taking into account the material or marital status of the parties and other circumstances noteworthy.

Calculation of alimony is possible only with the official income of the father. If he receives most of his salary illegally (“in an envelope”), then he will not be able to calculate the percentage of hidden income.

The child has not yet been born, but the husband already refuses him - what to do?

Take your time to make hasty decisions and interrupt your pregnancy. Remember that inside you have a new life, your bloodthirsty, and your Great mission to give birth and raise this person. The refusal of the father from the child does not mean that you cannot raise him yourself.

If a man abandoned you, and you are in a position, then if possible seek the help of a psychologist. You can also find support from loved ones, relatives, or friends. They will help you in difficult times, support and comfort.

Try to avoid communicating with those people who are negative about your pregnancy and the whole situation as a whole, who constantly repeat “I told you ...”, “It was necessary to listen to me ...”, etc. Such words will certainly not bring benefits, and will only further exacerbate your psychological state. Now the only person you can rely on is just you.

How to tell a child that dad left?

how-to-explain-to-baby-what-dad-left

It is difficult to raise a child in an incomplete family. Difficulties are experienced by both the mother and the child. Children from an early age see the wrong model of the family, and this cannot but affect their subconscious. This is fraught with errors in the formation of your own family in the future. Also try not to say bad things about your father when your child — either only good or nothing.

Many women come up with versions that dad died. Psychologists do not recommend telling the child about the father in this way. It is better to come up with an unusual profession that explains the absence of a pope near. Perhaps the father flew into space or went on a long expedition. Use your imagination to injure your child less at an early age.

The husband abandoned the child - is it possible to find a new man?

Your husband left the family and left you with a child - consider this as a new opportunity! So now you are free and can build relationships with another man. It may not be so difficult for a young and interesting woman, as you think, to find a worthy admirer who will become you a reliable support and a new dad for a child.

It is a mistake to think that women with children are not needed and are not of interest to men. Do not cross yourself! Drive such thoughts away and take care of yourself. This is necessary not only for you, but also for your children who want to see a cheerful, active and purposeful woman in your face. Mom should be attractive and flowering.

Remember! If the husband abandoned the child and left you, then not you, but he became a loner! The most valuable thing remains with you - children. The man who left the family became lonely and, perhaps, he will regret his action more than once.

    In general, the whole process is well resolved in a lawsuit. Yes, and the percentage of child support is good, though you do not need to get into a pose if the father does not recognize the child.
    You need to do the examination at your own expense, because you are already independent and must prove your case.
    It is very difficult to grow without male support, so child support is only a little help. But then explain to the child that his father does not need him is sad.
